These Terms of Use, together with our Privacy Policy and Cookie Policy, constitute the Agreement that applies to Users of the SPOTTER Website. If you access and/or use the SPOTTER Website located at https://www.spotter.sport, this agreement becomes legally binding on you.

These terms apply only to users of the SPOTTER Website.

If you disagree with any provision of the Terms of Use, please immediately stop using the SPOTTER Website.

When referenced in these Terms, our Privacy Policy, and our Cookie Policy, the terms listed below have the following meanings:

Intellectual Property

Unless explicitly stated otherwise in these Terms or in our Privacy Policy, the SPOTTER Website and all content available on it are protected by SPOTTER's intellectual property rights. Therefore, copying and/or downloading any portion of the SPOTTER Website's content, in whole or in part, is strictly prohibited without SPOTTER's explicit written consent. Furthermore, SPOTTER holds all intellectual property rights, even if they are not explicitly mentioned in this Privacy Policy.

In view of the above, any use of the content or part of the content on the SPOTTER Website without SPOTTER's prior authorization is considered a violation of intellectual property rights. As soon as SPOTTER becomes aware of any unauthorized use, it will take all available legal measures to protect its intellectual property rights.

Protection of Name and Logo

The logo is the exclusive property of SPOTTER, which has the sole right to use it and to prohibit its use by any third party.

Unless explicitly stated in the Terms and the Privacy Policy, it is strictly forbidden to use the name, logo, or trademark of Spotter DOO without prior explicit written permission from authorized representatives of Spotter.

Disclaimer of Liability

All information that is available or otherwise included on the Spotter Website is provided "as is" and "as available," solely for informational purposes. Such information should be interpreted with caution, and SPOTTER assumes no responsibility for any damage, error, omission, inaccuracy, or other harm that may result from the use of any information, links, or other content available on the Spotter Website. SPOTTER makes no warranty that the Spotter Website-including all information, links, and other content found on it-is complete and error-free, nor that any current discrepancies will be rectified.

Third-party Websites

The Spotter Website may contain links to third-party websites, which have their own terms and privacy policies. Such terms and privacy policies may differ significantly from the Terms and the Privacy Policy of the Spotter Website, and Spotter has no control over them. Accordingly, Spotter assumes no responsibility for the availability of third-party websites or for the terms and privacy policies applied to their users and visitors.

The fact that a link to a third-party website is placed and made available on the Spotter Website does not imply that Spotter endorses or approves the services or products offered through those third-party websites.

Spotter is not responsible for any information originating from another service provider that you may access via a link on the Spotter Website.

Force Majeure

Neither Spotter nor the User shall be held liable for any breach of this Agreement caused by unforeseen events or circumstances beyond their reasonable control, which prevent them from fulfilling their obligations under this Agreement. Such events include, but are not limited to, natural disasters, war, civil unrest, terrorist attacks, actions of legislative or executive authorities, strikes, internet disruptions, or other circumstances that may qualify as force majeure under applicable law.

Changes to the Spotter Website and/or Amendments to the Terms

• Changes to the Spotter Website
  Spotter may periodically update the Spotter Website in accordance with Spotter's business operations and other legitimate interests. We may, at our own discretion, change the content of the Spotter Website, discontinue its operation, or remove certain parts of it, which may result in the temporary unavailability of the Spotter Website for use.
  
• Changes to the Terms
  Spotter reserves the right to amend these Terms and the Privacy Policy at any time, at its own discretion. Any amendments to the Terms shall come into effect upon their publication on the Spotter Website. To remain informed, please check the Terms and the Privacy Policy regularly, bearing in mind that the current version of these terms is legally binding on you.
  

If you continue to use and access the Spotter Website after such amendments have been published, you will be deemed to have accepted all updated versions of the Terms and Privacy Policy.

Partial Invalidity

In the event that any competent court determines that any provision of the Agreement is null or invalid, the validity of the remaining provisions of the Agreement shall not be affected, and they will remain in full force. If any provision of the Agreement conflicts with a legal provision, causing such provision of the Agreement to become invalid, that provision shall be deemed amended to the extent necessary to comply with the law. The amended provision shall retain as much of its original meaning as possible, with the amendment limited to what is necessary to fulfill the purpose of the Agreement.

Dispute Resolution

This Agreement shall be governed by, construed, and enforced in accordance with the laws of the Republic of Serbia, excluding its conflict of laws provisions. Any disputes arising out of or in connection with this Agreement shall be finally settled by arbitration organized in accordance with the Rules of the Belgrade Arbitration Center. A sole arbitrator shall decide the dispute. The arbitration proceedings shall be conducted in the English language.

Entire Agreement

The provisions of these Terms, the Privacy Policy, and the Cookie Policy, including any amendments thereto, constitute the entire agreement between you and Spotter regarding the subject matter of this Agreement and supersede any prior written and oral agreements and arrangements between you and Spotter.

In the event of any inconsistency between the provisions of this Agreement and any agreement, arrangement, representation, or information published on our Spotter Website, or any other data contained in any materials or correspondence between you and Spotter, this Agreement shall prevail.
